    1. Objective

This Privacy Policy describes our data practices with respect to your personal information, including what types of information we collect, how we collect, use, disclose and store that information, and how you can make choices regarding that information. “Personal Information” means any information that is or can reasonably be linked to you.

 

This Privacy Policy applies to andazi.ge and all other websites, applications, products, services and other offerings (collectively, the “Service” or “Services”) owned and controlled by Andazi ltd. and our affiliates and subsidiaries (“Andazi”, “we”, “us”) that link to this Privacy Policy or offline locations that make this Privacy Policy available to you. It does not apply to information collected by third parties or information collected in the context of your employment with us.

 

Your use of the Services is also governed by our Terms and Conditions.

    2. Types of Personal Information We Collect and How We Collect It
When you use the Services, you may be asked to provide us with personal information, such as when registering for an account, making a purchase, signing up for our newsletters, participating in a promotion, responding to our surveys, requesting support, or applying for a job. The categories of personal information we collect include:

 

      2.1 Information provided to you through the Services

 

Contact identifiers, including your name, email address, mailing address, and telephone number.


Characteristics or demographics, such as your age and gender.


   Commercial or transactional information, including records of products or services you have purchased, obtained, or reviewed.


  Account credentials, including your username, password, password hints, and other information for authentication or account access.


   Payment information, including your payment instrument number (such as a credit or debit card number), expiration date, and security code, as needed to process your payments. This information is processed by our payment processors. We do not have access to your payment instrument number.


  User-generated content, including the content of any messages you send to us (such as feedback, questions, or survey responses) or post publicly on the Services (such as in product reviews or blog comments).


Contact identifiers associated with other users. If you choose to use our referral service to tell a friend about Andazi, we may collect your friend’s personal information, such as their email address. We will automatically send your friend a one-time email inviting them to purchase an Andazi product. We will retain your friend’s information to send this one-time email and to track the success of our referral program. Do not provide us with information about other users without their express consent.


Professional, employment or education-related information, including your employment and work history, records, writing samples, references and other information necessary for your job consideration.


Please do not provide us with information that we do not request.

 

      2.2 Information collected when you visit our stores

 

We collect information about you when you visit our stores in person. For example, we install security cameras to record video for security purposes. In some stores, we install video cameras with software that allows us to count the number of customers who enter our stores and track their physical movement within our stores. The software does not perform facial recognition, determine a customer’s age, ethnicity or gender, or otherwise use information to identify a specific individual.

 

      2.3 Information collected from your device or browser

 

When you use the Services, we and the third parties we work with automatically collect information from your browser or device. The categories of information we automatically collect include:

 

  • Device identifiers, including your device's IP address.

  •  

  • Device information, including your device's operating software and browser (e.g. type, version, and configuration), internet service provider, and regional and language settings.

  •  

  • Internet activity, including information about your browsing history and interactions, such as the features you use, the pages you visit, the content you view, purchases you make or consider, and the time of day you visit our website.

  •  

  • Inaccurate location data, such as location derived from an IP address or data that indicates city or zip code level.

This information is automatically collected through the Cookie technologies incorporated into our Service, as described below:

 

  •      Cookies. Cookies are small text files that are placed on your browser when you visit a website, open or click on an email, or interact with an advertisement. Our service uses session cookies (which expire when you close your browser) and persistent cookies (which expire on a set expiration date or when you manually delete them). We include both first-party cookies and third-party cookies (when cookies are served by a third party with whom we work). We use cookies for a variety of purposes, including to help our website operate, personalize your browsing experience, prevent fraud and for security, perform measurement and analytics, and deliver advertising (including targeted advertising).

  •        Pixels. Pixels (also known as web beacons) are pieces of code embedded within

    2.4 Information collected when you use Glow

 

When you use our Glow light and companion app, we collect information about how you use Glow, such as when you turn it on, off, or change the brightness setting. Your device type.

      2.5 Information collected from other sources

 

We also collect information from other sources. The categories of sources from which we collect information include:

 

Business partners who offer co-branded services, sell or distribute our products, or participate in joint marketing or promotional activities.


Third-party vendors and related parties with whom we work in connection with the provision of analytics, advertising, security and fraud prevention services.


Social media platforms you interact with. For example, when you “like,” “follow,” or otherwise engage with our content on social media (such as our brand page or direct message), we may collect information such as your contact identifiers and any comments you provide to us. If you publicly reference our Service on social media (for example, by using a hashtag related to us in a tweet or post), we may use your reference to or in connection with our Service.


Data providers, such as licensors of private and public databases.


Public sources.


     2.6. Information we receive

 

We derive new personal information from other information, including to generate personal information about your likely preferences or other characteristics.

 

     2.7 Sensitive information

 

To the extent that any of the categories of information we collect are sensitive categories of personal information under applicable law, we process such information only for the limited purposes permitted by applicable law. We do not sell or use sensitive categories of personal information for targeted advertising or to draw conclusions.

      3. How we use your information


    We collect and use personal information in accordance with the practices described in this Privacy Policy, including in the following ways:

 

     Service provision. We use information to provide services to you, including to operate the Service, create and maintain your account, and provide support.


     Personalize your experience. We use information to personalize your experience and show you content that is of interest to you.


   Communications. We use information to communicate with you about updates, security alerts, policy changes, and other transactional notices. We also use information to personalize and deliver marketing communications to you. Communications may be by email, where you opt-in, or text message.


    Analytics. We use information to understand trends, usage, and activities, for example, through surveys you respond to and technologies we integrate into the Service (such as Google Analytics). We also use information for research and development purposes, including to improve our Services and make business and marketing decisions.


     Advertising. We work with agencies, ad networks, technology providers and other third parties to place advertisements about our products and services on other websites and services. For example, we place advertisements through Google and Facebook that you may see on their platforms, as well as on other websites and services. As part of this process, we integrate technologies into our own Services, as well as into our advertisements that appear on other websites and services. Some of these technologies may track your activities over time and across non-affiliated services and may collect or infer information about you in order to show you relevant advertising based on your preferences and interests (“Targeted Advertising”). We also use audience matching services (which are a type of targeted advertising) to reach people who have visited our Services or are identified in one or more of our databases (“Relevant Advertising”). This is done by providing a list of hashed email addresses to the third party or by incorporating a third party pixel into our own service and the third party complies with common agreements between our data and their data. For example, we integrate the Facebook pixel into our service and may disclose your hashed email address to Facebook as part of our use of Facebook Custom Audiences.


    Promotions. When you voluntarily enter a Promotion, we use your information as described in the Official Rules governing the Promotion, as well as for administrative purposes and as required by law. By entering a Promotion, you agree to the Official Rules governing this Promotion except to the extent prohibited by applicable law. We, the Sponsor and our Affiliates may use your name, voice and/or likeness in promotional or marketing materials.


     Security and Enforcement. We use information to prevent, detect, investigate, and resolve fraud, violations of policies or terms, threats, or harm.


   Recruitment. We use information to make recruitment decisions and to anticipate employment contracts.


    At your direction or with your consent. We use information for additional purposes where you direct us to use it in a certain way or with your consent.


    Sometimes we collect or de-identify information so that it is no longer considered personal information. We may use non-personal information for any purpose, to the extent permitted by applicable law. For details about your choices regarding the use of your information, see “Your Privacy Choices” below.

                   4. How we share your information


Andaz may disclose your information in the following ways:

 

  • Service providers. Many of the third parties we work with are service providers who collect and process information on our behalf. Service providers perform services for us, such as payment processing, data analytics, marketing and advertising, website hosting, and technical support. To the extent required by law, we contractually prohibit our service providers from processing the information they collect on our behalf for purposes other than to perform the Services, although we may allow them to use non-personal information to the extent permitted by applicable law.

  • Third-party vendors and related parties. Some of the third parties we work with act as our service providers in some contexts, but in other contexts have independent control over the processing of your information. For example, we disclose information to ad networks, technology providers, and other third parties who help provide targeted advertising, but may also use the information for their own purposes. For these third parties, we encourage you to review and become familiar with their policies and terms of use.

  • Business Partners. We disclose information to our business partners in connection with offering co-branded services, selling or distributing our products, or engaging in joint marketing or promotional activities.

Once you have posted information, you will not be able to edit or delete such information, subject to applicable law.

We also disclose information to protect the rights, property, life, health, safety, and security of ourselves, the Service, or anyone else.

          5. Third parties


       We may provide or offer portions of our Services through websites and services controlled by third parties. In addition, we may integrate technologies, including those disclosed in the “How We Collect Information” section above, that are controlled by third parties. Except when third parties act as our service providers, they, and not we, control the purposes and means of processing any information collected from you, and you should contact them directly to address any concerns you may have about their processing. The data practices of third parties are subject to their own policies. Including what information they collect, your choices, and whether they store the information in Georgia or elsewhere. We encourage you to review and become familiar with their privacy policies and terms of use.

        6. Data security


We implement and maintain reasonable administrative, physical and technical security safeguards to protect your information from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction. However, no transmission over the Internet is completely secure and we cannot guarantee the security of your information.

If you would like your account to be removed from our website and you have an account with us, you can delete your account through your account settings. We will process your request in accordance with our data retention practices.

 

     7. Information storage

We retain information for as long as is reasonably necessary for the purpose for which it was collected, and as necessary to comply with our legal obligations, resolve disputes, prevent fraud, and enforce our agreements.

 

      8. Children


The Service is not directed to children under the age of 13, and we do not knowingly collect personal information from children. If you are a parent or guardian and believe that we have collected personal information from children, please contact us as set forth in the “Contact Us” section. We will delete the personal information accordingly.

9. Changes to our Privacy Policy


We reserve the right to revise and republish this Privacy Policy at any time. Any changes will be effective upon posting of the revised Privacy Policy. Your continued use of our Services indicates your agreement to the posted Privacy Policy. If the changes are material, we may provide you with additional notice to your email address.

  10 Financial settlement and return policy

 

These Terms and Conditions (“Terms”) apply to the Andazi (“Andazi”, “we”, “us”, “our”) website located at www.andazi.ge and all related websites. The Sites, collectively, include retail locations operated by Andazi (“Andazi Store”) and any Products (as defined below) offered on the Sites, any Andazi Stores or any bona fide third party retailer, online or e-commerce platform or other third party channel (each, a “Third Party Seller”). Please read these Terms carefully. By accessing or otherwise using our Sites, or by ordering, purchasing, accepting or using any product or service offered by Andazi, you agree to be bound by these Terms, as well as any other terms, guidelines or rules that apply to any part of the Sites or the Andazi Store, without limitation or qualification. If you do not agree to these Terms, you may not use the Services or order, purchase, accept or use the Products. These Terms provide that all disputes between you and andazi relating to these Terms, your use of or access to the Services, and/or your ordering, purchasing, receiving, or use of Products will be resolved in accordance with the laws of Georgia. 

 

I. Confidentiality

 

We have adopted a Privacy Policy, which you should refer to so that you can fully understand how we collect and use your information. The Privacy Policy is also incorporated into these Terms.

 

II. Electronic communication

 

When you visit any of the Sites or send us email, you are communicating with us electronically. You hereby consent to receive communications from us electronically. We will communicate with you by email or by posting notices on any of the Sites. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

 

III. Authority

 

None of our sites or any portion of our sites are directed to persons under the age of 13. If you are under the age of 13, do not use or access any of the sites.

 

If you are using the Site on behalf of a company, entity or organization (collectively, an “Organization”), then you represent and warrant that you (a) are an authorized representative of that organization; (b) have the authority to bind that organization to these Terms; and (c) agree to be bound by these Terms on behalf of that organization.

 

IV. Copyright

 

Unless otherwise noted, all textual content included on any andazi site, displayed in any Andazi store or on any product, including images, illustrations, designs, icons, photographs, video clips and written and other materials (collectively, the “Andazi Content”) is the property of Andazi or its licensors, partners or affiliates and is protected by Georgian and international copyright laws. The compilation of each site is the exclusive property of Andazi and is protected by Georgian and international intellectual property laws. Any unauthorized use of any Andazi Content on any site is strictly prohibited and may violate copyright and trademark laws, and/or privacy, publicity and/or communications regulations and statutes. You may use the materials or content on the site only with our prior written and express authorization. V. Trademarks

 

All trademarks, service marks and trade names (collectively, the “Marks”) that appear on any Site, in any Andazi Store or on any Product are owned by andazi and are registered with Sakpatenti. You may not display or reproduce the Marks in any form without the prior written consent of Andazi, and you may not remove or otherwise alter any Trademark notices from any Content offered or obtained through the Sites.

 

VI. Limited License and Access to the Sites

 

We grant you a limited license to use the Sites for your personal use only. Accordingly, this license does not authorize you to: (a) resell or make any commercial use of the Sites or any Content on the Sites; (b) modify, adapt, translate, reverse engineer, decompile, disassemble, or otherwise reduce to a human-readable form any Content on the Sites that is not intended to be read in such a manner. This includes using HTML or other code to view the Sites directly, other than for interpretation and display in a web browser; (c) copy, imitate, display, reproduce, distribute, publish, download, display, perform, publish, or transmit any Content on the Sites (including any marks) in any form or by any means.

VII. Accounts, Forms, Registration and Passwords

 

You represent and warrant that the information you provide when creating a Proverb account on any Site and at any other time will be true, accurate, current and complete.

 

To facilitate your current and future purchases on the Sites, you may choose to create an account by providing an email address and password. Please note that you may choose to use the Site and make purchases without creating an account. If you create an account, your account is personal to you and you may not share your account information or grant access to your account to any third party. Since you will be responsible for all activities that occur under your access credentials, you agree to use reasonable efforts to prevent unauthorized access to or use of the Sites and to maintain the confidentiality of your username and password and any device you use to access the Sites.

You agree to immediately notify us of any breach of the confidentiality of your login information.

 

If you have any reason to believe that your account information has been compromised or that a third party has gained access to your account, you agree to immediately notify Andazi by email at contact@andazi.co.uk . You will be solely responsible for any damages incurred by Andazi and others due to any unauthorized use of your account.

 

VIII. Taxes and Payments; Transportation; Home Delivery -; Third Party Seller Purchases

 

Prices. The price of products available for purchase through any Site will be displayed to you on that Site. The price of products available for purchase through any Andazi Store will be displayed next to or beside the product. Product prices may be displayed in local currency, depending on where you purchase the products. We will notify you of any applicable taxes before you place an order.  

 

11. Payments.

The Sites and Andazi Stores currently use third parties to process payments. Our third-party payment processors accept payments by various credit cards, including Visa, MasterCard, American Express, and others, as detailed on the applicable payment screen. You may also finance the purchase of products in installments from financial institutions in Georgia.

 

12. Home delivery.

For home delivery and unpacking of mattresses, the customer or an adult must be present at the designated time and location at the delivery address. If an adult is not present at the time of delivery, Andaz reserves the right to leave the package with a secure receiving agency (e.g., doorman, concierge, or building package center). 

Purchases from a third-party seller.

Andazi may offer certain products through third-party sales.

 Andazi does not control the third-party seller and your order, purchase, receipt or use.

Any product provided by any third-party seller is a transaction solely between you and them (the third party).

 Each third-party vendor may have its own terms, guidelines, or policies for which Andaz is not responsible.

13. Refunds and Returns; Cancellations

 

Cancellations. You may cancel an order placed on the Sites or the Andazi Store at any time before the product is shipped. If the product has been shipped to the customer's address, the order will not be canceled.

 

If we are unable to refund the original payment method (for example, if the credit card you used to make the purchase has been canceled or closed), you will be refunded in cash. If you purchased a product from the Sites or the Andazi Store using a promo code or gift code, the value of any promo code will not be refunded. In the event that Andazi is unable to refund the applicable sales tax, this portion of the refund will not be refunded. Please note that we do not refund shipping costs or taxes.

Registration

To purchase products on the Andazi website (andazi.ge), registration is required on the website, for which it is necessary to fill out the registration form with the following data:

   Name

   Address

   Email

   . Login password

Customers can register on the website during the product purchase process and also before purchasing.

Registration/authorization before purchase occurs after the user selects "Login" from the website's main menu.

Login/authorization is possible in the following ways:

  . Through social networks

  . With Google

  By email.

The User confirms and warrants that:

  The information provided by him/her is complete and correct;

  He/She is a legally capable adult who has reached the age of 18;

  . Will not use another person's personally identifiable information for the purpose of registering on the Andazi website;

  . Will not use a name that may be derogatory or offensive to any other person;

  Will not use the website to spread false information;

  . Will not use the website to impersonate another company, a company employee, or any other person;

   . Will not violate the rights of another person by unlawful or harmful actions;

  . Will not use any device or program whose purpose is to obtain information from the website and/or interfere with its normal functioning;

  . Will protect copyright and related rights, will not carry out unauthorized use, processing and publication of information available on Andazi: logo, pictogram, picture, graphic, image, patent, trademark, design and any other type of intellectual property, without the prior written consent of Andazi;

  . Will not use another user's account;

  . Will not attempt to gain access to another user's authentication information;

  Will not take any action that would jeopardize the proper functioning of Andazi;

  . Will not take any action that is prohibited by applicable law, this Agreement, or andazi's Privacy Policy.

Placing an order and purchasing products by the user

After the user selects a product and places it in the virtual cart, in the case of a new user, the following information will be required: email, name, mobile number, and address where they would like to receive the purchase.

To pay for Andazi products, you will be redirected to the payment page. Before making the payment, the user is obliged to verify the address and contact information provided by him in order to ensure smooth delivery of the purchased products. In case of providing an incorrect/incomplete address and/or contact information, the user is responsible for any delay in the delivery of the products.

The user will be able to verify information about the product they purchased on their personal page.

Andazi reserves the right to refuse or cancel a customer's order if there is suspicion of fraud, unauthorized or illegal transactions.

After the consumer pays for the product, the ownership of the purchased item is fully transferred to the consumer.

14. Disclaimer

 

We do not represent or warrant the truthfulness, accuracy, or reliability of any content posted by third parties. You agree that any reliance on materials posted by third party service providers is at your own risk. By using the Sites, you accept the risk that you may be exposed to content that is inappropriate or otherwise objectionable. We may change, suspend, or discontinue any content on the Sites at any time, including the hours of operation or the availability of Site content or any other features, without notice or liability.

 

User Disputes. We are not responsible for any disputes or disagreements between you and any third party with whom you interact using the Sites. You assume all risks associated with your interactions with third parties. You must resolve any disputes directly with the third party. To the extent permitted by law, you release Adaz from all claims, demands, and damages arising from any disputes between you and any third party sites. You also must not involve us in any such disputes. Use caution and common sense when using Third Party Sites.

 

Accuracy of Content. We make no representations about the accuracy, reliability, completeness, or timeliness of any content on any Site. Similarly, we make no representations about the accuracy, reliability, completeness, or timeliness of any data from third-party service providers, or the quality or nature of third-party products or services obtained through the Sites. Use the Sites at your own risk.

 

We make no promises and, beyond the processes permitted by law, disclaim all liability for specific results from the use of the Sites.

15. Dispute Resolution

 

Generally. You and Andaz agree that any dispute arising out of or in any way related to these Terms, your use of the Sites or Services, or your purchase, receipt, order, or use of any Products will be resolved by binding arbitration or litigation. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and may be subject to very limited review by the courts. Arbitrators may receive the same damages and relief that a court could. This agreement to arbitrate disputes includes all claims arising out of or in any way related to these Terms, your use of the Sites, Services, or your purchase, receipt, order, or use of any Products. Any dispute between you and Andaz will be governed by the laws of Georgia.

Enforceability. If the section entitled “No Class Action” is held unenforceable, or if the entirety of this Section XVII is held unenforceable, then the entire Section XVII will be null and void, and in such event the parties agree that the exclusive jurisdiction and venue set forth below will govern any action arising out of or relating to these Terms, or your purchase, receipt, order, or use of or access to the Sites, any Andazi Store, Services, or Products.

Choice of Law; Venue. These Terms shall be governed by and construed in accordance with the laws of Georgia, excluding its conflict of law principles. If a claim or proceeding is permitted under these Terms, then you and Andaz agree to submit to the laws of Georgia, 

 Termination

 

Notwithstanding any of these Terms, we reserve the right, without notice or liability and in our sole discretion, to terminate your license to use the Sites, and to block or prevent further access to and use of any Site or any of the Services. For any reason or no reason. In the event of termination, these Terms will still apply.

 

We reserve the right to update and revise these terms at any time.

 

We review these Terms from time to time to ensure that they are consistent with applicable law. Accordingly, we reserve the right to update and revise these Terms at any time. You will be notified if these Terms have been revised since your last visit to the Website by the “Effective Date of the Current Policy” at the top of this page; provided, however, that we will attempt to provide you with prior notice of any material changes that will apply to you. Your use of or access to the Services constitutes your acceptance of these Terms.

 

Refusal

 

No failure by either party to exercise any right or to waive any breach of these Terms by the other party, in whole or in part, shall prevent such party from exercising any further right or be deemed a waiver by such party of any subsequent breach of the Agreement by the other party under the same or any other term of these Terms.

 

Separation

 

If any term or condition of these Terms is held to be invalid, void or unenforceable for any reason, that term shall be severed and shall not affect the validity or enforceability of any remaining term or condition. Nothing in these Terms shall affect any optional statutory rights you may have.

 

Full agreement

 

Except as expressly stated above, these Terms (including any documents or terms expressly incorporated by reference into these Terms) constitute the entire agreement between you and Andaz relating to the purchase, receipt, order or use of the Services and/or Products and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, relating to the purchase, receipt, order or use of the Services and/or Products. A printed version of these Terms and any notices delivered electronically will be admissible in any judicial or administrative proceeding based on or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally created and maintained in printed form. Any rights not expressly granted herein are reserved.
